F1 Cockapoo Puppy Purchase Warranty

Please read the Health Warranty completely before placing a deposit on a puppy. By placing a nonrefundable/transferable deposit on a Cockapoo puppy, you are agreeing to the terms and conditions within this Purchase Agreement/Health Warranty.
We require a $300 dollar deposit in order to hold the puppy of your choice. There is a 4% PayPal Fee. This deposit is not transferable to another puppy or litter. The puppy you place your deposit on is the puppy you will take home with you. The deposit is applied to the total price of your Cockapoo puppy.
This is also your receipt for your Cockapoo Puppy.
Please keep a copy of this Health Warranty. Hard copies are not provided at pick up.
Any puppy discounted/reduced for any reason except Military will not come with a Microchip or Goody Bag.
Occasionally we will discount some puppies due to age, color, etc. If this happens and your puppy is similar you will not get a discounted rate.
ALL deposits are non-refundable for the puppy described above unless the puppy is found to have a medical issue that will keep the Cockapoo Puppy from being a quality lifelong companion. If, at the 7 week well puppy veterinarian health check, the Cockapoo Puppy is determined to be unfit for purchase, the Buyer is entitled to 1) an available cockapoo puppy 2) refund of deposit or 3) if there is a wait list at that time go to the top of the wait list and select a puppy from the next available litter.
Deposits are non-transferable. Once you select a puppy, place a deposit on a puppy, that is the puppy you will take home. You cannot transfer to another puppy or litter at a later date.
Contagious/Infectious, Hereditary Disease Guarantee.
If at any time within 6 (six) months from the date/time the Cockapoo Puppy is picked up by the Buyer from the Seller a licensed veterinarian certifies the Cockapoo Puppy to be unfit for purchase due to a hereditary disorder the puppy will be replaced with a puppy of equal value as described above. Should Buyer refuse the Cockapoo puppy when offered by the Seller, the Seller is released from all obligations to the Buyer. Certification of un-fitness must be presented to the Seller within 48 (forty-eight) TOTAL hours (including week ends and holidays) following the veterinarian exam/diagnosis. Puppy must be returned within 96 TOTAL hours (including week ends and holidays) from veterinarian certification. Failure to notify Seller or provide Seller with documentation/return puppy in timeframes outlined renders the Health Warranty null/void. The Seller retains the right to have the Puppy's condition validated by another licensed veterinarian of their choice. This warranty is void in the event of an undetermined or inconclusive diagnosis. All travel expenses to return Puppy is responsibility of the Buyer.
If the Cockapoo Puppy dies within 6 (six) months from the date/time the Cockapoo Puppy is picked up by the Buyer from the Seller a necropsy must be performed by a licensed pathologist (not a veterinarian) to determine the cause of death (natural or euthanized). Failure to have a necropsy performed by a licensed pahologist will render the Health Warranty null and void. Pathologists reports must be made available to Seller within 7 (seven) total days (including week ends and holidays) from date of findings to the Seller. Our veterinarian will review the Pathologist reports and if our veterinarian finds the fault to be a hereditary condition the Buyer will be provided a replacement puppy of equal value/color/gender. This warranty is void in the event of an undetermined or inconclusive diagnosis. If Buyer refuses the Cockapoo puppy when offered by the Seller, the Seller is released from all obligations to the Buyer.
In all instances described above, the certification must contain:
- Name of the owner with the date/dates of examination;
- the name, breed, color, sex and age of the Cockapoo Puppy;
- a statement of the findings and that the veterinarian certifies the Cockapoo Puppy to be unfit for purchase;
- all x-rays, documentation and veterinarian findings relating to the health defect;
- where the Cockapoo Puppy has died, a statement setting forth cause of death along with the necropsy report;
- the name and address of the certifying veterinarian and the date of the certification.
The following defects are not considered serious/life threatening and not considered hereditary; are not covered under any part of the Health Warranty:
- undescended testicles
- umbilical or inguinal hernias
- regrowth of dew claws
- cherry eyes
- grade 1 or 2 luxating patellas
- grade 1 or 2 innocent/juvenile heart murmurs,
- kidney/Bladder/Urinary Tract Infection
- ear mites
- other common puppy problems such as fleas, lice or ticks, coccidia, giardia, parasites (internal or external), kennel cough or any other type of bacterial /viral infections.
Parvovirus or Distemper are not covered by this Health Warranty at any time as the puppy has only been started on it's inoculations prior to going to their new home and family. Your puppy's immune system is not fully developed until he/she has completed it's series of puppy vaccines.
No refunds will be given at any time for travel to/from veterinarians, shipping puppy/dog, x-rays, laboratory fees, any treatments, medications or any veterinarian fees/care unless outlined above.
BUYER AGREES to take their puppy to a licensed veterinarian within 72 TOTAL HOURS (including week ends and holidays) from date/time of pick up/delivery from the Seller. If your regular veterinarian is not available, you are required to take the puppy to another veterinarian. Failure to have this exam on file will cause this guarantee to be null and void.
BUYER AGREES to neuter/spay the puppy on or before Cockapoo puppy's 7 month birthdate. This puppy is sold as a companion dog not for breeding purposes.
BUYER AGREES if at any time the Buyer is unable to keep the Cockapoo Puppy/Dog they may, at Buyer's expense, return the Cockapoo along with all Medical records, fully vetted for age and freshly groomed to the Seller. Buyer must deliver the Cockapoo to the Seller at Buyer's expense. The Buyer agrees they will not be reimbursed in any way (monetary or other) for returning the Cockapoo to the Seller.
BUYER AGREES the coat type of the Cockapoo will vary as characteristics are inherited from both the poodle and the cocker spaniel. There may even be some variety within a litter. The three possible coat types are a tight curly coat, a loose wavy/ringlet coat and a straighter coat. Acura Cockapoos, Inc. does not guarantee the coat texture of a puppy as it matures to an adult. We do not give any guarantee for adult size/structure, color changes, coat texture, eye coloring, shedding or hypo allergenic. Once you select a puppy that is the puppy you will go home with regardless of size, weight, height, coat texture or color.
At no time do we reimburse for time off work, travel time or gas expenses.

We do not warrant the temperament of our Cockapoo puppies. Temperament is determined by genetics and environment. Too often, nice puppies develop temperament problems as a result of the way they were raised after they leave the are of the Seller. We have no control over environment once the Puppy leaves the care of the Seller.
It is understood and agreed to by the parties to this agreement that this agreement and the purchase and sale of the said dog shall fall under the jurisdiction of the laws of the City of Irmo, South Carolina and the State of South Carolina and that any matters with respect to this Agreement shall be dealt with as per the laws governing this location. It is further understood that any circumstances, situations, disputes arising which are not covered within this Agreement shall be remedied at the discretion of the breeder and the breeder's decision shall be final and binding. This agreement is non-transferable.
This Health Warranty is non-transferable. It is only in effect for the original BUYER whose name appears on the PayPal Deposit or Personal Check provided to make the original nonrefundable/transferable deposit.
BUYER AGREES they have read and understand the terms set forth. BUYER AGREES that when they made their initial nonrefundable/transferable deposit via PayPal or other methods (personal check, cash) they automatically agreed to the terms and conditions set forth above in the Health Warranty. By accepting these terms in this Purchase Agreement/Health Warranty the Buyer waives all rights to file any legal claim against the Seller.
