Acura Cockapoos Guarantee/Contract

Basic Information

Puppies sold by Acura Cockapoos are honestly represented and evaluated as accurately as possible.
There are no refunds on Deposits unless the puppy is found to be unfit for purchase at the six/seven week veterinarian well puppy check up. Should this occur, you will be immediately notified and have the following options: 1) receive a full refund of your initial deposit 2) select an available puppy or 3) wait for another litter (which you will be placed in line according to the date your wait list deposit was received).
Once you have selected a puppy, we remove that puppy from the available puppies thereby making the puppy unavailable for another family to adopt. If you decide you want a different puppy you will be assessed a $300 processing fee. The only exception would be if at the six/seven week veterinarian vet visit the puppy is found to be unfit for purchase. Should this occur, you will be immediately notified and have the following options: 1) receive a full refund of your initial deposit 2) select an available puppy or 3) wait for another litter (which you will be placed in line according to the date your wait list deposit was received).
We, Acura Cockapoos, reserve the right to cancel a sale of any puppy prior to the pickup date/time if for some reason we find the home is unsuitable for one of our puppies.
If a puppy is being shipped, final payment (puppy, shipping admin fee, microchip and other fees) must be paid with a Cashiers Check (made payable to Deborah Van Laan) 10 days prior to shipping or sale will be canceled and no refund on initial deposits.
Cockapoo puppies prices vary by sex, color, and age. Please understand that if you reserve a puppy for a particular price and, later, a similar puppy is offered at a lesser price, the price of your puppy does not change. We sometimes, not often, reduce the prices of particular puppies as they get older, change colors. etc.

Contagious/Infectious, Hereditary Disease Guarantee

The above-described puppy is believed to be in good health at the time of the sale as this puppy has been vet checked as a healthy pet by our veterinarian. In order to verify the good health of the puppy, Buyer must take the puppy to a licensed veterinarian within 72 hours of delivery/pick up of the puppy. Buyer agrees to take their puppy to a veterinarian within 72 hours of delivery day/time. This veterinarian appointment must include an overall health exam and fecal exam (both must be completed in the same veterinarian visit). If the puppy arrives to you on a holiday or weekend, then the puppy must be taken to a licensed veterinarian on the following working day. If your regular veterinarian is not available, you are required to take the puppy to another veterinarian. Failure to have this exam on file will cause this guarantee to be null and void.

Seller is not responsible for parvovirus infections if diagnosed after 72 hours of delivery date AND time.

If at any time within fourteen days following the delivery of a companion dog to the purchaser, a licensed veterinarian certifies the Puppy to be unfit for purchase due to a non-congenital cause or condition or within six months certifies your Puppy to be unfit for purchase due to a congenital or hereditary cause or condition, the purchaser has the right to elect one of the following options.

1. the right to return the Puppy and receive a refund of the purchase price, including sales tax, and reimbursement of the veterinary fees incurred before the purchaser's receipt of the veterinary certification. The seller's liability for veterinary fees under this option must not exceed fifty percent of the purchase price, including sales tax, of the Puppy;

2. the right to retain the Puppy and to receive reimbursement for veterinary fees incurred before the purchaser's receipt of the veterinary certification and the future cost of veterinary fees to be incurred in curing or attempting to cure the Puppy. The seller's liability under this option must not exceed fifty percent of the purchase price, including sales tax, of the Puppy;

3. the right to return the Puppy and to receive in exchange a Puppy of the purchaser's choice, of equivalent value, and reimbursement of veterinary fees incurred before the purchaser's receipt of the veterinary certification. The seller's liability for veterinary fees under this option must not exceed fifty percent of the purchase price, including sales tax, of the Puppy;

4. the right to receive a full refund of the purchase price, including sales tax, for the Puppy or, in exchange, an Puppy of the purchaser's choice of equivalent value, and reimbursement of veterinary fees incurred before the death of the Puppy if the death occurs within fourteen days of the date the purchaser takes possession, except where death occurs by accident or injury sustained during that period. The seller's liability for veterinary fees under this option must not exceed fifty percent of the purchase price, including sales tax, of the Puppy.

The seller shall accept the veterinary certification of unfitness only if the certication is delivered by the Buyer to the Seller within five days following the purchaser's veterinarian finding the dog unfit for purchase.

The veterinarian certification must contain:

1. Name of the owner(s);

2. the date/dates of examination;

3. the breed, color, sex and age of the Puppy;

4. a statement of the veterinarian findings;

5. a statement that the veterinarian certifies the Puppy to be unfit for purchase;

6. an itemized statement of veterinary fees incurred as of the date of the certification;

7. where the Puppy is curable, the estimated fee to cure the Puppy;

8. where the Puppy has died, a statement setting forth the probable cause of death; and

9. the name and address of the certifying veterinarian and the date of the certification.

Proof in the form of a veterinarian receipt of veterinarian visit with fecal exam within 72 hours of delivery must also accompany the veterinarian certification of unfitness. It is the sole responsibliity of the Buyer to provide all necessary documentation to the Seller. If proper documentation is not provided to the Seller by the Buyer within five days of the veterinarian finding the dog unfit for purchase the contract is null and void.

When the purchaser presents a veterinary certification of unfitness to the seller, the seller must confirm the purchaser's election in writing. Where the Puppy has died, the veterinarian shall hold the carcass until the Seller is reached to make arrangements for autopsy.

Should any monies need to be refunded, the Seller has 45 days to refund.

Spay/Neuter Requirements

Puppy is purchased as a pet/companion dog only and may not be bred (intentionally or unintentionally). Buyer agrees to spay or neuter this puppy between the age of four and seven months of age to avoid accidental pregnancies.

Medical Information

Your puppy had its tail docked and dew claws removed between 3 and 5 days old. This removal of dew claws is 99% effective at this age. Occasionally, a dew claw will grow back. We do not cover any fees associated with the removal of the dew claw(s) if needed after the initial removal.
At no time, in any part of this guarantee, including the SC Lemon Law, do we guarantee against conditions brought on by environmental changes, stress or exposure to adverse conditions that we cannot control once the puppy leaves our care. If the puppy shows no signs or symptoms of a problem we do not and cannot treat them. Therefore, we do not guarantee against Hypoglycemia, Coccidiosis, Giardia, Parasites (Internal or External), Viral, Bacterial or Fungal Infections, Allergies or Ear Mites.
At no time do we reimburse for time off of work, travel time or gas expenses.
Should the puppy be returned to Acura Cockapoos, all expenses for return of the puppy/dog is the responsibility of the Buyer.
Should a "refund" puppy needed to be shipped, all expenses for shipping will be split evenly between the Buyer and Seller.

Miscellaneous

The temperament of your puppy is based on the amount of time YOU give to your dog and to its development and socialization. Puppy Kindergarten/Obedience classes are recommended for all puppies.
We do not give any guarantee for adult size, color changes, coat texture, shedding or hypoallergenic.
The Buyer agrees to never release the puppy/dog to any animal shelter, dog pound, animal rescue or research facility.
The Buyer agrees that should the occasion arise whereby the Buyer no longer desires ownership of the puppy/dog the Buyer will notify the breeder immediately. Buyer can place the puppy with a close friend or relative ONLY but MUST notify the breeder of a new home and with all contact information. If no home is available w/a close relative or friend, the dog is to be returned to Acura Cockapoos. If puppy/dog is returned to Acura Cockapoos, no money will be refunded however if the dog requires vet care, grooming, etc. a $200 fee will be charged for these services.
The Buyer agrees to never advertise the dog for sale/adoption on any website such as Puppyfind, Craigslist, Ebay, Kijiji, online newspapers, etc.
The Buyer agrees to never advertise the dog for sae/adoptoin in any local, state or national newspaper, bulletin, flyer, etc.
If your Cockapoo puppy or older dog has a medical/temperament issue you agree to contact Acura Cockapoos before taking any legal action so the issue can be worked out amicably by both parties. By reading this agreement and purchasing one of our Cockapoo puppies or adopting one of our older dogs, you agree to not go to any internet sites such as but not limited to Forums, Facebook, RipoffReport, CompanySucks, MySpace, Blogs, etc. where you can publicly tell of your experience with your pet and Acura Cockapoos in a negative way. This includes but not limited to verbally discussing/contacting other breeders, those who have purchased puppies from us, veterinarians, dog training professionals, friends, etc. If it is found this to occur, legal actions will be taken against you and any other parties involved in the slander in the amount of $10,000 per person and a retraction on all forums, professionals, friends, etc. found.
It is understood and agreed to by the parties to this agreement that this agreement and the purchase and sale of the said dog shall fall under the jurisdiction of the laws of the City of Irmo, South Carolina and the State of South Carolina and that any matters with respect to this Agreement shall be dealt with as per the laws governing this location. It is further understood that any circumstances, situations, disputes arising which are not covered within this Agreement shall be remedied at the discretion of the breeder and the breeder's decision shall be final and binding.
This agreement is non-transferable. It is only in effect for the original Purchaser whose name appears on this contract.
